The Kansas Agricultural Remediation Act was passed by the Kansas Legislature in 2000. The act created the Kansas agricultural remediation program for the purpose of reimbursing responsible, eligible parties for agricultural remediation expenses incurred after July 1, 1997.

The remediation fund is administered by a Governor-appointed Board. The fund is financed by annual fees on pesticide product registration, pesticide dealers, commercial grain storage, fertilizer products and custom blenders.

The Board meets quarterly to review applications received at least four weeks prior to the meeting date. Receipts for all expenses must be submitted to the Board within two years of incurring the costs. The Board manages the program and distributes funds through a KDHE scoring system which prioritizes funding for remediation sites that most likely pose a threat to human health and safety.

Reimbursement Determination

The Act sets a maximum reimbursement amount at the following levels: If a person is assessed a fee, then that person is eligible to receive 90% of total remediation costs greater than $1,000 and less than or equal to $100,000, plus 80% of total remediation costs greater than $100,000 and less than or equal to $200,000.

A person who has not paid an assessment – or a pesticide dealer who has paid the required $5 assessment – is eligible to receive 100% of expenses greater than $1,000 and less than or equal to $10,000.

The Board has developed an application process and has defined eligible and ineligible costs in regulation. A list of eligible and ineligible expenses can be found in K.A.R. 125-1-6 and 125-1-7.

Examples of eligible costs include: consultant fees, soil and groundwater sampling, analytical costs, removal of contaminated soil and groundwater remediation costs. Examples of ineligible costs include: attorney’s fees, loss of income, chemical replacement costs and all expenses over two years older than the date of the application.

Prior to submitting your application, make sure the following documents are included with the application form:

  2. Copies of all receipts or invoices to support the requested remediation expenses, along with proof of payment of those invoices.
  3. An insurance statement indicating that the applicant does not maintain insurance to cover the remediation expenses.

2026 Board Meeting Schedule

Applications must be submitted to the Board four weeks prior to the next Board meeting.
